Terms and Conditions

These terms govern your use of PocketPerks, a digital loyalty card platform operated by VenturesSky Ltd (“PocketPerks”, “we”, “us”). By creating a merchant account, or by using a PocketPerks loyalty card as a customer, you agree to these terms.

PocketPerks lets businesses run digital loyalty programs — customers collect stamps toward a reward on a card that lives in their phone’s wallet or home screen, with no app to download. PocketPerks offers a free plan, which needs no credit card, and paid plans billed monthly or yearly.

• You must provide accurate information when creating an account
• You’re responsible for keeping your password, and any staff accounts you create, secure
• You’re responsible for the accuracy of your reward program details and any communications you send to your customers through the service
• We may suspend or terminate an account used for fraudulent, abusive, or unlawful activity

• Stamps and rewards have no cash value and cannot be exchanged for cash
• Rewards are set and honoured by the individual business, not PocketPerks — we provide the platform, not the reward itself
• A business may deactivate a location or close their program; existing stamp history is preserved but new stamps can no longer be issued through that location

We take this seriously and back up the database automatically every night, with copies kept in two separate off-site locations so that a single failure can’t wipe out both the live data and its backup. That said, no system is perfect: in the worst case — if something fails between one night’s backup and the next — up to approximately 24 hours of the most recent activity could be lost. We are also continuing to improve this further (more frequent, near-continuous backups) as the service grows. We do not guarantee uninterrupted or error-free availability of the service.

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the service or another user’s account
• Interfere with or disrupt the service or its infrastructure
• Use the service to send spam or unsolicited communications

PocketPerks and its branding, design, and underlying software are owned by VenturesSky Ltd. Merchants retain ownership of their own branding (logos, business names) uploaded to the platform.

PocketPerks is provided “as is”. To the fullest extent permitted by law, we are not liable for indirect or consequential losses arising from your use of the service, including loss of revenue, business, or data beyond what’s described in the Data backups and availability section above. Nothing in these terms excludes liability that cannot be excluded under UK law.

You may stop using PocketPerks at any time. We may suspend or terminate access to the service for breach of these terms, with notice where reasonably possible.

We may update these terms as the service changes. We’ll update the “Last updated” date above whenever we do; significant changes will be communicated more directly where appropriate.

These terms are governed by the laws of England and Wales.
